Justice Court Procedures for Filing Civil Charges
The statutory limit for filing a civil suit in the Justice Court is $3,500. Any debts, property damage, etc. which amount to more than $3,500 must be handled through other courts.
Open Account
- Provide to the Court a copy of the outstanding bill along with a current and accurate PHYSICAL address.
- Fill out the paperwork.
- The cost for this action is $85 for one defendant, $100 for two defendants at the same address, and $148 for two defendants at different addresses.
Complaint for damages
- Provide to the Court a copy of the outstanding bill along with a current and accurate PHYSICAL address.
- Fill out the paperwork.
- The cost for this action is $85 for one defendant, $100 for two defendants at the same address, and $145 for two defendants at different addresses.
Remove tenant
- Provide the Court with a copy of the proper notice given to the Tenant/Tenants, along with a current and accurate PHYSICAL address.
- Fill out the paperwork.
- The cost for this action is $85 for one defendant, $100 for two defendants at the same address, and $145 for two defendants at different addresses.
Replevin
- Provide the Court with a copy of the proof of ownership, along with current and accurate PHYSICAL address.
- Fill out the paperwork. (If you want immediate possession you shall post a cash bond which is double the value of the property. If the defendant posts a cash bond, they will retain the property until the Court date.)
- The cost for this action is $85 for one defendant, $100 for two defendants at the same address, and $145 for two defendants at different addresses.
